THE MEDIA GLOBO CORPORATION and its subsidiaries and affiliates will take every measure to protect the patents, trademarks, service marks and copyrights of its business enterprise by making lawful applications and filings with the United States Patent and Trademark Office, an Agency of the United States Department of Commerce. The "MEDIA GLOBO" trademark and service mark is now, and continues to remain, the exclusive and proprietary property of The MEDIA GLOBO Corporation and its subsidiaries, affiliates and public shareholders. Currently, a lawful application for registration of the "MEDIA GLOBO" service mark is pending before the U.S. Patent and Trademark Office, an Agency of the U.S. Department of Commerce. While the pending "MEDIA GLOBO" trademark and service mark registration may be referred to under USPTO Application Serial No. 77174169, it should be clearly noted that no final determination as to the registrability of the mark has been made. The "MEDIA GLOBO" trademark and service mark was approved for publication by the USPTO January 2, 2008 and was lawfully published for opposition on January 22, 2008 for a thirty (30) day period until February 22, 2008. On February 21, 2008 a request for 30-day "Extension of Time to Oppose" was received and granted by the USPTO Trademark Trial and Appeal Board ("TTAB") from previously unidentified legal counsel for "Globo Comunicacao E Participacoes S.A." of the country of Brazil; as potential opposer of the mark. On March 18, 2008 a Second Request for an additional 60-day "Extension of Time to Oppose" was received from the same legal counsel for the potential opposer, and granted by the TTAB; provided that the would-be opposer had until May 21, 2008 to file its opposition. On June 3, 2008 the TTAB published that a Notice of Opposition had been filed; in response to which MEDIA GLOBO shall have until July 13, 2008 to file its Answer. Effective July 3, 2008, MEDIA GLOBO timely filed an Answer to the Notice of Opposition; which "Applicant's Answer to Notice of Opposition" was duly published by the TTAB on July 10, 2008 under Opposition No. 91184401 to Serial No. 77174169. Deadline for a Discovery Conference between MEDIA GLOBO and the Opposer has been set by the TTAB for August 12, 2008. Preparations remain underway for affirmative legal defense of MEDIA GLOBO's lawful rights to its trademark(s) before the TTAB. See: www.uspto.gov .
Classification of Good and Services: The International Classification of Goods and Services for the "MEDIA GLOBO" service mark, as may be amended, subject to regulatory review and approval, may be recited for identification under the trademark application as International Class 36: "Providing financial and investment services, namely, asset acquisition, consultation, development and management services and venture capital services, namely providing financing to emerging and start-up companies, all in the field of internet media." See the U.S. Acceptable Identification of Goods and Services Manual; including implementation of the 9th edition of the Nice Agreement on January 1, 2007.
Filing Basis: Section 1(b), Intent to Use: MEDIA GLOBO and/or its subsidiaries and affiliates is (are) presently using the "MEDIA GLOBO" mark in various domestic U.S. and international commerce and/or in connection with the identified goods and/or services. 15 U.S.C. Section 1051(a), as amended. The mark was first used at least as early as 12/26/2006 and first used in commerce at least as early as 03/12/2007, and continues in use in such commerce. MEDIA GLOBO had a lawful and bona fide intention to use or use through its related company(s) or licensee(s) the mark in commerce on or in connection with the identified goods and/or services as of the filing date of the application. 15 U.S.C. Section 1051(b). The filing date of record with the U.S. Patent and Trademark Office by The MEDIA GLOBO Corporation for the "MEDIA GLOBO" mark was 05/07/2007.
